CONCERNING
THE EIGHTH AMENDMENT TO REGULATION OF THE MINISTER OF FINANCE No. 92/PMK.02/2005 CONCERNING STIPULATION OF CERTAIN TYPES OF EXPORTED GOODS AND RATE OF EXPORT LEVY
THE MINISTER OF FINANCE,
Considering:
- a. that in the context of securing the needs for basic material for cooking oil industry and in maintaining stable price of domestic cooking oil, it is necessary to adjust the tariff rate of Export Levy on Oil Palm, CPO and its Derivative Products;
- b. that based on the consideration as described in a., it is necessary to stipulate Regulation of the Minister of Finance concerning the Eighth Amendment to Regulation of the Minister of Finance No. 92/PMK.02/2005 concerning Stipulation of Certain Type of Exported Goods and the Rate of Export Levy;
In view of:
- 1. Government Regulation No. 35/2005 concerning Export Levy on Certain Goods (Statute Book of the Republic of Indonesia No. 82/2005, Supplement to Statute Book of the Republic of Indonesia No. 4531);
- 2. Presidential Decree No.20/P of 2005;
- 3. Regulation of the Minister of Finance No. 92/PMK.02/2005 concerning Stipulation of Certain Type of Exported Goods and Rate of Export Levy as amended seven times, the latest amended by Regulation of the Minister of Finance No. 94/PMK.01/2007.

THE REGULATION OF THE MINISTER OF FINANCE CONCERNING THE EIGHTH AMENDMENT TO REGULATION OF THE MINISTER OF FINANCE No. 92/PMK.02/2005 CONCERNING STIPULATION OF CERTAIN TYPE OF EXPORTED GOODS AND THE TARIFF RATE FOR EXPORT LEVY.
Article 1
Several provisions in Regulation of the Minister of Finance No. 92/PMK.02/2005 concerning Stipulation of Certain Type of Exported Goods and Rate of Export Levy that have been amended seven times by Regulations of the Minister of Finance as follows:
- a. No. 130/PMK.010/2005;
- b. No. 30/PMK.02/2006;
- c. No. 51/PMK.02/2006;
- d. No. 88/PMK.010/2006;
- e. No. 61/PMK.011/2007;
- f. No. 83/PMK.02/2007;
- g. No. 94/PMK.01/2007;
have been amended as follows:
1. Insert two (2) paragraphs, namely paragraph (1a) and paragraph (1b) in between paragraph (1) and paragraph (2) of Article 3 so that the entire Article 3 reads as follows:
"Article 3
(1) Particu1ar type of exported goods and the tariff rate for Export Levy as described in Article 2 shall be as stipulated in Attachment to this Regulation of the Minister of Finance.
(1a) The stipulation and imposition of Export Levy tariff on exported goods in the form of Palm Oil, CPO, and its derivative products, the provisions below shall apply:
- a. For referenced price less than USD 550 (five hundred fifty US Dollars) per ton, the tariff for Export Levy shall be as set forth in Attachment I to this Regulation of the Minister of Finance;
- b. For referenced price exceeding or equivalent to USD 550 (five hundred fifty US Dollars) per ton and less than USD 650 (six hundred fifty US Dollars) per ton, the tariff for Export Levy shall be as set forth in Attachment II to this Regulation of the Minister of Finance;
- c. For referenced price more than or equivalent to USD 650 (six hundred fifty US Dollars) per ton and less than USD 750 (seven hundred fifty US Dollars) per ton, the tariff for Export Levy shall be as set forth in Attachment III to this Regulation of the Minister of Finance;
- d. For referenced price more than or equivalent to USD 750 (seven hundred fifty US Dollars) per ton and less than USD 850 (eight hundred fifty US Dollars) per ton, the tariff for Export Levy shall be as set forth in Attachment IV to this Regulation of the Minister of Finance;
- e. For referenced price higher than or equivalent to USD 850 (eight hundred fifty US Dollars) per ton, and less than USD 1,100 (one thousand one hundred US Dollars) per ton, the tariff for Export Levy shall be as set forth in Attachment V to this Regulation of the Minister of Finance;
- f. For referenced price higher than or equivalent to USD 1,100 (one thousand one hundred US Dollars) per ton, and less than USD 1,200 (one thousand two hundred US Dollars) per ton, the tariff for Export Levy shall be as set forth in Attachment VI to this Regulation of the Minister of Finance;
- g. For referenced price higher than or equivalent to USD 1,200 (one thousand two hundred US Dollars) per ton, and less than USD 1,300 (one thousand three hundred US Dollars) per ton, the tariff for Export Levy shall be as set forth in Attachment VII to this Regulation of the Minister of Finance;
- h. For referenced price higher than or equivalent to USD 1,300 (one thousand three hundred US Dollars) per ton, the tariff for Export Levy shall be as set forth in Attachment VIII to this Regulation of the Minister of Finance.
(1b) the referenced price as described in paragraph (1a) is stipulated by he Minister who responsible in the Trade sector based on the price of CPO CIF Rotterdam.
(2) Is deleted".
2. Amend Attachments I, II, III, IV, V and VI as stipulated in Attachments I, II, III, IV, V and VI to this Regulation of the Minister of Finance.
3. Add two (2) Attachments, namely Attachments VII and VIII as stipulated in this Regulation of the Minister of Finance.
Article II
This Regulation of the Minister of Finance shall take effect after three (3) days as of the date it is stipulated.
For public cognizance, this Regulation of the Minister of Finance shall be announced by placing it in the State Gazette of the Republic of Indonesia.
